Agreement to Terms

By submitting a booking, you (“Guest,” “you,” or “your”) agree to be bound by these Terms & Conditions (“Terms”). These Terms constitute a legally binding contract between you and Warlocks, Inc. (“we,” “us,” or “our”). If you are booking on behalf of other travelers, you represent that you have the authority to bind them to these Terms, and all references to “Guest” include those travelers.

Please read these Terms carefully before booking. If you do not agree with any part of these Terms, do not submit a booking.

1. The Journey

Your journey includes the accommodations, meals, transportation, guided experiences, and other inclusions specified in the published itinerary and your booking confirmation. The specific dates, destinations, and pricing for your journey are provided on the booking page and in your confirmation documents.

Our journeys are not conventional tours. They are transformational pilgrimages designed for those seeking meaningful encounters with sacred sites and traditions. Participation requires a spirit of openness, respect for fellow travelers, and the physical ability to navigate sites that may include uneven ground, stairs, and areas without climate control.

Group size limits are specified in the published itinerary for each journey.

2. Pricing and Payment Schedule

Pricing for your journey is listed on the booking page and in your confirmation. Double occupancy pricing is per person, based on two guests sharing one room. Single occupancy pricing includes a single supplement and guarantees a private room.

Payment Schedule:

  • Deposit: Due upon booking to confirm your reservation
  • Subsequent Payments: Due on the dates specified in your confirmation

Late Payment Policy:

All payments must be received by the dates specified in your booking confirmation. If any scheduled payment is not received by its due date, your reservation will be automatically canceled and all prior payments will be forfeited. We are under no obligation to send reminders, extend deadlines, or reinstate canceled reservations.

If your reservation is canceled due to non-payment:

  • All payments previously made are forfeited and non-refundable
  • Your spot may be released to other guests
  • Reinstatement, if offered, is at our sole discretion and may require payment in full plus a reinstatement fee

It is your responsibility to ensure payments are submitted on time. Payment processing delays, bank errors, or failure to receive reminder emails do not excuse late payment.

Payment Methods: We accept major credit cards and bank transfers. All prices are in U.S. Dollars.

3. What Is Included

Your journey includes the accommodations, meals, transportation, site admissions, guided experiences, and other services specified in the published itinerary. Please review the itinerary carefully to understand exactly what is included in your journey.

4. What Is Not Included

Unless specifically listed as included in the published itinerary, the following are not included in your journey price:

  • International airfare
  • Passport and visa fees
  • Travel insurance (strongly recommended; see Section 9)
  • Alcoholic beverages beyond those specified as included
  • Spa treatments and personal services
  • Optional excursions not specified in the published itinerary
  • Laundry and dry cleaning services
  • Personal expenses, souvenirs, and purchases
  • Gratuities (see Section 5)
  • Any costs arising from failure to comply with travel documentation requirements
  • Medical expenses, evacuation, or repatriation costs
  • Room service where not included
  • Wi‑Fi and communication charges where not included
  • Any items not specifically listed as included

5. Gratuities

Unless otherwise specified, gratuities for local guides, drivers, vessel crew, and hotel staff are not included in your journey price. We will provide guidance on customary tipping practices prior to departure.

Gratuities for your hosts are neither required nor expected, but are graciously accepted if you feel moved to offer them.

6. Cancellation Policy

All payments are non-refundable.

We understand that circumstances change. However, we must secure accommodations, transportation, permits, and services well in advance, and our suppliers require payment regardless of individual cancellations. For this reason:

  • Deposits are non-refundable from the date of booking.
  • All subsequent payments are non-refundable from the date they are made.
  • No refunds will be issued for cancellations at any time, for any reason, including illness, injury, family emergencies, travel restrictions, or any other circumstance.

If you must cancel, your payments are forfeited. We strongly recommend purchasing travel insurance with Cancel for Any Reason (CFAR) coverage to protect your investment (see Section 9).

Cancellation by Us: If we must cancel the journey due to circumstances beyond our control—such as political instability, natural disasters, pandemics, or failure to meet minimum enrollment—you will receive a full refund of all payments made. This is the only circumstance under which refunds are issued.

7. Shared Room Bookings

If two guests book a shared room (double occupancy) and one guest cancels:

  • The remaining guest must pay the single supplement to retain their place on the journey, OR
  • The remaining guest may find a replacement roommate, subject to our approval, OR
  • The remaining guest may cancel and forfeit all payments made.

No refunds will be issued to either party. The financial arrangement between guests sharing a room is solely between those guests. We are not responsible for collecting or disbursing payments between roommates. If you book on behalf of another guest, you are responsible for the full booking amount regardless of that guest’s actions.

Room Share Matching: We may offer to match solo travelers who wish to share a room. Such arrangements are made at our sole discretion. If we are unable to find a suitable match, solo travelers must either pay the single supplement or cancel without refund.

8. Transfer of Booking

Bookings are not transferable. If you are unable to travel, you cannot transfer your booking to another person. You must cancel your booking (forfeiting all payments) and the new traveler must submit a new booking, subject to availability.

9. Travel Insurance

We strongly recommend that all guests purchase comprehensive travel insurance with Cancel for Any Reason (CFAR) coverage.

Travel insurance can protect your investment in the event of trip cancellation, interruption, delay, medical emergencies, lost luggage, and other unforeseen circumstances. Given our strict no-refund policy, CFAR coverage is particularly valuable—it allows you to cancel for any reason and receive reimbursement of up to 75% of your non-refundable trip costs.

To qualify for CFAR coverage, you must typically purchase your policy within 21 days of your initial deposit. This deadline cannot be extended. After you book, we will send you detailed instructions for obtaining coverage.

Standard covered reasons (such as illness, injury, or death in the family) are typically reimbursed at 100%. CFAR extends protection to any reason at all, reimbursed at 75%.

We do not require travel insurance as a condition of booking. However, by booking without travel insurance, you acknowledge that you are assuming full financial risk for any circumstances that prevent you from traveling.

By submitting your booking, you acknowledge that:

  • You understand travel insurance is strongly recommended
  • You understand you must purchase CFAR coverage within 21 days of your deposit to qualify
  • You understand that all payments are non-refundable regardless of whether you purchase insurance
  • You assume full responsibility for any losses if you choose not to purchase insurance

10. Travel Documents

Passport Requirements:

International travel requires a valid passport. Your passport must:

  • Be valid for at least six (6) months beyond your return date
  • Have sufficient blank pages for visa stamps
  • Be in good condition (not damaged, torn, or excessively worn)

You are solely responsible for ensuring your passport meets these requirements. If your passport is expired or expiring soon, apply for renewal immediately. Passport processing times can be lengthy, and we cannot assist with expedited processing.

Visa Requirements:

Many destinations require visas for entry. Visa requirements vary by destination and by your country of citizenship. We will provide general guidance on visa requirements for your journey, but you are solely responsible for researching and obtaining all necessary visas and entry permits.

We cannot be held liable if you are denied boarding or entry due to improper or missing documentation. No refunds will be issued for any costs or losses arising from documentation failures.

11. Health and Physical Requirements

Fitness for Travel:

Participation in our journeys requires reasonable physical fitness. Depending on the journey, you may encounter:

  • Sites with uneven ground, steps, and low ceilings
  • Areas without air conditioning in extreme temperatures
  • Walking on varied terrain
  • Boarding and disembarking from boats or other transportation
  • Early morning departures and full days of activity

If you have mobility limitations, chronic health conditions, or concerns about your ability to participate, please contact us before booking to discuss whether the journey is appropriate for you.

Medical Conditions:

You are responsible for consulting with your physician before traveling. We strongly recommend:

  • Ensuring all routine vaccinations are up to date
  • Discussing any recommended travel vaccinations with your doctor
  • Bringing sufficient supplies of any prescription medications in original containers
  • Carrying a copy of prescriptions and a letter from your doctor if traveling with controlled substances

Medical Emergencies:

Medical facilities at your destination may not meet the standards you are accustomed to at home. Emergency evacuation from remote areas can be difficult and extremely expensive. Your travel insurance should include emergency medical coverage and evacuation/repatriation benefits.

We are not responsible for any medical expenses you incur during the journey. All medical costs, including evacuation, are your sole responsibility.

Pregnancy:

Due to the physical demands of travel and limited medical facilities in some locations, we do not recommend our journeys for guests who will be pregnant during travel. If you are or may become pregnant, please consult your physician before booking.

12. Conduct and Removal from Journey

Our journeys are group experiences, and the quality of that experience depends on mutual respect among all participants. By booking, you agree to:

  • Treat fellow guests, hosts, guides, and staff with courtesy and respect
  • Follow instructions from hosts and guides regarding safety and site protocols
  • Refrain from behavior that disrupts the group or diminishes others’ experience
  • Comply with all local laws and customs
  • Respect the sacred nature of the sites we visit

We reserve the right to remove any guest from the journey if their behavior is disruptive, dangerous, or incompatible with the group experience. This includes but is not limited to:

  • Harassment or abuse of other guests or staff
  • Intoxication that impairs participation or creates disturbance
  • Failure to follow safety instructions
  • Illegal activity
  • Conduct that reflects poorly on the group or jeopardizes our access to sites

If you are removed from the journey for conduct reasons, you will be responsible for your own transportation home and any associated costs. No refunds will be issued.

13. Itinerary Changes

We reserve the right to modify the published itinerary at any time due to circumstances beyond our control, including but not limited to:

  • Weather conditions
  • Site closures or access restrictions imposed by local authorities
  • Safety or security concerns
  • Supplier or vendor availability
  • Mechanical issues with transportation
  • Acts of God, political events, or force majeure

We will make reasonable efforts to provide comparable alternatives when changes are necessary. Itinerary changes do not entitle guests to refunds or compensation.

14. Accommodations

Hotels and Lodging:

Accommodations are based on the properties named in our published itinerary. In the unlikely event that a contracted property becomes unavailable, we will substitute accommodations of comparable quality. Such substitutions do not entitle guests to refunds.

Room assignments are at the property’s discretion. Specific room requests (view, floor, location) cannot be guaranteed.

Bed Configurations:

Bed configurations vary by room type and are specified in the published itinerary. Not all bed types can be converted. If you require a specific bed configuration, verify availability before booking. We cannot accommodate bed configuration changes after booking.

15. Limitation of Liability

Independent Suppliers:

We act as organizers of our journeys and contract with independent suppliers including hotels, transportation providers, restaurants, and local guides (“Suppliers”). These Suppliers are independent contractors, not our employees or agents.

We are not liable for any injury, damage, loss, delay, or irregularity caused by the acts or omissions of any Supplier, including but not limited to:

  • Airlines and their personnel
  • Hotels and their staff
  • Vessels and their crew
  • Ground transportation providers
  • Restaurants
  • Site guides and guards

Any claims arising from Supplier services must be made directly against the Supplier.

Assumption of Risk:

International travel involves inherent risks, including but not limited to:

  • Political instability and civil unrest
  • Terrorism
  • Crime
  • Infectious diseases
  • Extreme weather
  • Traffic accidents
  • Accidents at sites
  • Watercraft incidents

By booking a journey, you acknowledge these risks and voluntarily assume them. You agree to hold us harmless from any claims arising from these risks.

Limitation of Damages:

To the fullest extent permitted by law:

  • We shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your participation in the journey or these Terms
  • Our total liability for any claim arising from the journey shall not exceed the total amount you paid for the journey
  • We shall not be liable for any emotional distress, mental anguish, or disappointment except where caused by physical injury resulting from our gross negligence

Force Majeure:

We shall not be liable for any failure to perform our obligations under these Terms if such failure results from circumstances beyond our reasonable control, including but not limited to: war, terrorism, civil unrest, government actions, pandemics, epidemics, natural disasters, severe weather, strikes, labor disputes, transportation disruptions, or any other force majeure event.

16. Indemnification

You agree to indemnify, defend, and hold harmless Warlocks, Inc., its owners, officers, employees, agents, hosts, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your breach of these Terms
  • Your violation of any law or the rights of any third party
  • Your conduct during the journey
  • Any claims made by other travelers in your booking
  • Your failure to obtain proper travel documents
  • Any medical expenses or evacuation costs incurred on your behalf

17. Photography and Media

We may take photographs and video during the journey for promotional and documentary purposes. By participating in the journey, you grant us permission to use your likeness in photographs and video for marketing, social media, and other promotional purposes without compensation.

If you do not wish to be photographed, you must notify us in writing before the journey begins and identify yourself to your hosts at the start of the journey. We will make reasonable efforts to exclude you from promotional materials, but we cannot guarantee your image will not appear in group photographs or candid shots.

Your Photography:

You are welcome to take photographs and video for personal use during the journey. However, certain sites may prohibit photography or require additional permits. You must comply with all site regulations regarding photography. Photography permits, where required, are your responsibility and expense unless otherwise specified.

18. Privacy

We collect personal information necessary to operate the journey, including names, contact information, passport details, emergency contacts, and payment information. This information is shared with Suppliers as necessary to provide the services included in your journey.

We do not sell your personal information to third parties. We may use your contact information to send you communications about the journey and future offerings.

19. Disputes and Governing Law

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

Dispute Resolution:

Any dispute, claim, or controversy arising from or relating to these Terms or the journey shall be resolved as follows:

  • Informal Resolution: You agree to first contact us in writing to attempt to resolve any dispute informally. We will endeavor to respond within thirty (30) days.
  • Mediation: If informal resolution is unsuccessful, either party may initiate mediation administered by a mutually agreed mediator in Boston, Massachusetts. The costs of mediation shall be shared equally.
  • Binding Arbitration: If mediation is unsuccessful, any remaining dispute shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Boston, Massachusetts. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver:

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.

Time Limitation:

Any claim or cause of action arising from or relating to these Terms or the journey must be filed within one (1) year after the cause of action accrues. Claims filed after this period are forever barred.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

21. Entire Agreement

These Terms, together with our published itinerary and any written communications from us regarding your booking, constitute the entire agreement between you and us regarding the journey. These Terms supersede any prior agreements, representations, or understandings, whether written or oral.

No modification of these Terms shall be effective unless made in writing and signed by an authorized representative of Warlocks, Inc.

23. Acknowledgment

By submitting your booking, you acknowledge that:

  • You have read and understand these Terms & Conditions in their entirety
  • You agree to be bound by these Terms & Conditions
  • You understand that all payments are non-refundable
  • You understand that travel insurance with CFAR coverage is strongly recommended
  • You understand the CFAR eligibility deadline of 21 days from initial deposit
  • You are physically and mentally fit to participate in the journey
  • You accept the inherent risks of international travel
  • If booking for others, you have authority to bind them to these Terms
